There is an inevitable part in the process of rural collective land transferinto land for construction purposes. In this process, the state-ownedconstruction landtransferring fees is far higher than the rural collective land ofbadly roughed collection, the price difference is one of the main reasons of therural land problem. The author tries to set up land development rights of ruralcollective system under China’s current law system, in order to achieve equalprotect the property ownership through the method of perfect the property,make the countryside and farmers’ interests shall not be violated.The land development rights refers to land use change the nature orincrease the intensity of land use. The successful practice of the main foreignhave British national land development system, the United States transferabledevelopment rights system and France’s legal limit density system. This paperanalyzes the present situation of rural collective land rights, explored thetheory of rural land reform, and it is necessary and feasible to set up the ruralcollective land development rights system has the.According to the principle of equal protection ownership, rural collectiveland development rights should belong to the owner of the land, is themeaning of the ownership should be, specific included in the land use right. Inaddition to treats the rural collective land development rights as a legal right, this system can’t do without related system support. First, we need to establisha consolidated urban and rural land market and rural collective landdevelopment rights transfer market; secondly, we needs reasonable ruralcollective land development rights price evaluation system to regulate its price;at the same time, in order to avoid the countryside and farmers rushed to sellthe land development rights and reduce the government’s financial pressure,can adjust the interests of the land through the tax distribution.
