Currently, with the extensive use and development of artificial insemination, the negative effects which caused by the technology has become even more obvious, many crime issues in the technical activities are also growing cause for people’s concern and attention. Research on the specific performance and main features of this crime phenomenon, explore how to use Criminal Law to regulate in order to prevent and punish such behavior more effectively, has urgent reality and necessity.Depending on the differences of the specific against objects, the crime issues of artificial insemination activities can be divided into three categories, they are the type of inseminated women-against object, the type of embryo, sperm or egg-against object, and the type of artificial insemination management order-against object. The necessity of making these acts to be criminal including the macro and micro levels, the former necessity includes the practical needs of realizing the task of Criminal Law, conforming to the international criminal legislation trend and protecting the balance between crime and penalty; the latter necessity includes the danger of the acts themselves and the limitation of using the existing charges of Criminal Law to regulate those acts. There are five basic principles which should be strictly followed when regulating these crime issues by criminal manner, they are economy of Criminal Law, crime equaling penalty, maximum exhaust, overall co-ordination and precautionary. Recommended that we can learn from the advanced legislative experience of other countries and enrich our criminal regulation manner at the same time, improve the unit criminal penalty system in the basis of revising and improving parts of the existing counts and adding new charges in order to regulate and prevent such criminal acts more comprehensively and effectively.
