| Trademark names are kinds of mark which is directly registered with names of geographic regions in accordance with legal procedures. China is extremely rich in resources of names, names as the categories of public resources, not only to carry and contains specific humane and natural information, but also has inestimable economic value in the modern market. The commercial exploitation and utilization of public resources, put the stealth value of signposts into economic development, is the common concern issues of current theory and practical area. Our current legal system has many defects on protecting the trademark names, and the study is not preceded in-depth, all these are serious impediments to the full utilization of such resources, to some extent, is not conducive to the maintenance of the socialist market economic order.From the basic theory of privatization, we discuss the establishment of trademark fair use and the settlement of conflict between trademark names and geographical indications, and ultimately we have deep thinking on the improvement of trademark protection system. |
