A Study About The Role And Status Of The Lawyers Which Exist In The Period Of The End Of Qing Dynasty To The Early Stage Of Repubilc Of China

Due to the influence of chinese tradition law thought,economic,and political factors.the new occupation-lawyer appear to our country until the period which from the end of the Qing Dynasty to the early stage of the Republic of China.As an overseas imports occupation.the lawyer brought a brand new situation of the judicial practice to us.An in-depth study about the role and status of these lawyers which exist in this period.contribute to the promotion of the private law flourishing and the reform of the judicial system.It has a very important meaning that can promote the healthy development of the lawyer and the process of the socialist legal system.This paper is divided into five parts.The first part is introduction, the writer proposed the reasons and significance of the depth explore on the basis of the overview of the previous research achievements. The second part, I expounded that the whole process of the appearance of lawyer during the late Qing. then set forth respectively that the appearance of this profession, the rudiment of lawyer system and the legalization of lawyer in the end of Qing.The third part is concerning the role of lawyer at the end of the Qing Dynasty, summarize and present the effect of the lawyer.Through the analysis of cases.and propose dialectically. that at that moment, a lawyer can not only give some positive effect, but also some negative effect. The fourth part is concerning the status of lawyer at that time, delve into lawyer’s economic status, social status and political status from the perspective of income, of people and of political participation. The fifth part is the comments of lawyers in the end of the Qing.
