With the improvement of legal level in our country,litigation has become most people’s first choice to protect their rights.But some people use litigation to do illegal things to get others’interests.This is not only infringe upon the property rights,but also damage the normal judical order seriously.Its social harmfulness is great,this phenomenon is called litigation fraud.At present,the number of this things is increasing,and the legislation of our county especially in the criminal legislation, is still a legal blank.And in the theoretical research,there are a lot of disputes.There are many different viewpoints about how to qualitative.Whether it is a crime,it is still a question.After qualitive,how to regulate this kind of behavior,in order to safeguard judical authority and protect others’interests.It still need to solve the problems in theory and practice.Through analysis of the litigation fraud,put forward some suggestions of laws and regulations.
