At the present goal of building socialism nomocracy and managing state affairs according to law, and coupled with the rapid strides in the press media and public opinion, especially the network public opinion, it is a challenge to dialectically think about the relationship of the press and the criminal judicature. In the recent years, our country vigorously sparkplugs the public opinion surveillance, furthermore the criminal judicial independence in the field of criminal judicature and the freedom of the press are the two important marks of the modern nomocracy, and also are the organic composition part of the modern state constitution. The public opinion freedom is the manifestation of the press freedom; moreover it will lose the meaning of the press if the press media has no press freedom. The important worth of the criminal procedure consists on the judicial independence, and the functional value of the criminal procedure will have no means of effective realization without the criminal judicial independence. Therefore, how to deal with the relation of the press and the criminal judicature is the important research part of this thesis. In the main, the active participation in the criminal judicature of the press has active effect on the criminal judicature. In some cases, the intervention of the press conduce the effective treatment, and realize the equitable value of the criminal judicature, which promote the public trust power of the government. But there is no denying that in some criminal procedure cases, the unreasonable intervention of the press media brings extremely adverse effect on the criminal judicature, even severely damage the equity and independence of the criminal judicature. Therefore, how to balance the both relation, exert the active effect of the press media, and avoid the negative influence on the criminal judicature of the press media and public opinion become a challenge.
