The scholars have focused on the end of punishment for a long time, and since the ta rget-oriented penalty theory has been come out it’s always a significant part of the end of punishment theory. The traditional theory of the general purpose of the penalty theory can be divided into two kinds of retribution punishment with the end of punishment.The purpose of criminal theory since its inception through the many criminal law scho lars, has become a relatively complete theoretical system, as an integral part of the end of punishment theory. However, regardless of the end of punishment is the end of punis hment theory or the theory of binary penalty for the purpose of, the theory is only the penalty for the purpose of stay in monism and dualism, there is no majority of should i nto the scope of protection of legal interest to protect the well.
