| Folklore is the creation and generation to generation by a specificcommunity with the characteristics of art, culture and other culturalexpressions. World Intellectual Property Organization (WIPO) called itthe traditional creative and cultural expression.Xinjiang has a large area,multi-ethnic and more resources are very rich in folklore. Folklore here isdiverse and attractive, become the scenery and wealth.At present, special protection of intellectual property rights systemhas not been formed，various question and contradictions appear due tothe shortage of relevant regulation or law, the legislative work and thecorresponding system needs improvement. This dissertation， byresearching the intellectual property protection for folklore thoroughlyand systematically. Study the relationship between folklore andintellectual property theory, analysis of the legal conservation status andproblems of Xinjiang folklore. Analysis of existing legislation andpractice，discuss the elements, content, and form of folklore intellectualproperty, to put forward specific countermeasures. Hope to improve theprotection of intellectual property laws of the Xinjiang folklore. |
