Forestry Administrative Punishment Law Problem Analysis

The administrative punishment for forest public security is in violation of the regulations on administrative penalties forest. Forestry administrative punishment plays a very important role in the protection of ecological resources, the construction of legal society and maintaining social harmony. It has the important meaning of milestone on construction of legal system of public security and the forest public security case management. At present, in the implementation of the administrative punishment on forest, due to law enforcement subject, punishment procedures, legal internal mechanism, external environment and other various factors, does not adapt to resource conservation and ecological environment.There exist the following problems in practice:the first subject is the problems of punishment subject. For example, the subject in legal regulations is not clear, law enforcement subject is under dual jurisdiction, its function and authority is not clear and so on. The second subject is the deficiency of the punishment procedures, such as defects of forestry administrative punishment told programs, multifarious of approval procedures; The third subject is fine punishment in the application of the execution of and predicament; the fourth subject is arbitrary of law enforcement, abuse discretion; the fifth subject is that the environment of law enforcement is not ideal.On this basis, based on legal theory on the administrative punishment, combined with work experience in the grassroots forest public security authorities, the author analyses of the existing problems of forestry punishment related reasons and puts forward some suggestions and ideas by consummating forestry administrative punishment system and standardizing the actual operation of administrative punishment.
