| The court mediation is an important form to trial and solve civil disputes of the people’s court. It is a lawsuit activity as well as a system which possess Chinese characteristics in civil lawsuit and known as the "Oriental experience" which grounds in Chinese traditional legal culture. It plays a very important role in the process of solving disputes. However, with development of market economy and improvement the legal quality of broad masses, traditional court mediation mechanism can’t cope with increasing quantity and numerous kinds of civil disputes. How to solve civil rights disputes timely and thoroughly, improve the plural remedy efficiency, reduce the court pressure, reduce the lawsuit cost, promote positive operation of civil and commercial trial, so as to maintain the harmonious social environment is an urgent event.Through analysis of the court mediation principle in our country, let us better grasp the direction of the court mediation. Through analysis of properties and function value of the court mediation, we know court mediation plays an irreplaceable role in modern society. Then through comparative analysis with related system abroad, it is helpful to find the shortcomings of in China and provide reference valuable experience for how to improve the court mediation. At last, through analysis of present situation and existing problems of the court mediation in China, it indicates the necessity and urgency to complete court mediation system in our country. In the final section of the article, the author briefly analyzes how to perfect our court mediation system. |
