Research On Legal Supervision Mechanism Of Community Correction

Community Correction was formally written into the Eight Amendment toCriminal Law in2011. That Community Correction for probationer, parole, publiccontrolled criminal offender, criminal temporary-execution outside prison accordingto law, was also prescribed in the draft of amendment of Criminal procedure law inMarch2012.This is fully affirmed the pilot of Community Correction for many yearsin our country. More importantly, it formally recognizes the penalty nature ofCommunity Correction, from legal perspective. It makes the Community Correctionto a new height and a new stage. However, as a new penalty enforcement activity,Community Correction has many imperfections during the pilot’s process.As a state organization of legal supervision, the procuratorate have the right tosupervision Community Correction which at the end of the penalty execution. It isimportant to safeguard judicial justice and protection of human rights. In newsituation, the procuratorial organ should be more effective and practical for legalsupervision of Community Correction. This is worthy of our exploration andtheoretical study.This article was divided into five chapters. The first chapter briefly introducedthe definition and value of Community Correction. Besides, it pointed out that"supervision" is different with "legal supervision", and analyzed the content ofCommunity Correction. The second chapter systematically contained the legitimacy of Legal Supervision of Community Correction, and discussed the practicalsignificance of Legal Supervision of Community Correction. The third chapterintroduced legislation and present judicial condition of legal supervision ofcommunity correction, and analyzed the dilemma. The fourth chapter containedintroduced Community Correction in other countries. The fifth chapter contained thetentative exploration and improves on legal supervision mechanisms of CommunityCorrection.
