| 本文主要是通过对我国刑事案例指导制度运作问题的研究，为中国特色的刑事案例指导制度的构建提出具体完善的设想。全文从刑事案例指导制度的概念入手，结合国内外的相关经验，以审判机关的运作实践为视'，重点探讨我国刑事案例指导制度运作中出现的问题，并尝试性地提出解决这些问题的办法'完善我国刑事案例指导制度的措施。文章加上导言'结语一共有六大部分，具体安'如下：引言部分通过广州许霆案与云南何鹏案、四川孙伟铭案与南京张明宝案作对比，以类似案件的类似判决或不同判决结果作为比较标准，引出有关司法公正的话题，再由民众衡量司法公正的标准引出全文论述的核心——刑事案例指导制度。第一部分是对刑事案例指导制度的一个总的概述。这部分分为两小节，通过对刑事案例指导概念的界定进而探讨对刑事案例指导制度的定位问题。第二节对刑事案例指导制度的定位是该部分的核心内容。笔者从性质'效力两方面对刑事案例指导制度作出完整定位。第二部分旨在通过对刑事指导案例运行程序的论述，分析其在运行中存在的问题。对于运行程序，主要是从适用的前提、适用的规则、适用的程序三方面展开；通过对运行程序的观察，指出当前我国刑事指导案例运行中存在的指导案例数量少、法官技术水平低、制度定位不准确、监督救济机制缺乏等问题。第三部分是对域外刑事判例制度的考察评析。该部分在论述时不同于以往以 This article is mainly about the research on criminal case instruction systemoperation problems; with a view to put forward a specific and perfect vision onestablishment of criminal case instruction system with Chinese characteristics. Thefull text, starting from the criminal case instruction system concept, with thecombination of domestic and foreign relevant experience and the perspective ofjudicial organs operation and practice, is mainly focusing on Chinese criminal caseinstruction system operation problems, and proposes the measures to solve theseproblems and improve our criminal case instruction system experimentally. There aresix parts including introduction and conclusion, details as follows:For Instruction part, by comparing the similar cases such as cases of Xu Ting inGuangzhou and He Peng in Yunnan, Sun Weiming in Sichuan, with similar ordifferent judgment verdicts as a comparison standard, the topic of judicial impartialityis put forward; again by people’s attitude to justice, it leads to the core of the full textdiscusses--criminal case instruction system.The first part is a general introduction to the criminal case instruction system.This part is divided into two sections, based on the definition of the concept ofcriminal case instruction and the positioning of criminal guidance system. Thepositioning of criminal case instruction system of part is the core content of this part.From the nature and effectiveness of two aspects of the criminal case instruction system, the author makes a complete positioning for that.The second part focuses the problems existing in the operation of criminal caseinstruction system. Discussion on the running operation system is mainly carried outfrom the applicable premise, rules and procedure; through observation on the runningoperation, some problems are pointed out such as the lack of supervision and reliefmechanism and current criminal guiding cases existing in the operation, the lowtechnical level of judge, inaccuracy in system positioning, and etc.The third part is based on inspection of the extra-territorial criminaljurisprudence system assessment. This part is not analyzed from law differentiatecategories interpretation. On contrary, it is to analyze the difference of the differentlegal systems from the criminal judicial precedent system specific aspects as abreakthrough point. From the study it can be found the exploration of a way whichcould get rid of the limitations of the current law itself and improve judicial efficiencyis on the way in both common law and continental law countries.The fourth part is about the concrete construction criminal case guidance systemwith Chinese characteristics. This part is the key of the whole article. It is developedfrom the system, operation and security protection level to construct specific andperfect system. Each level is detailed with the content that what should be improvedand learnt, even to the point of what we need to construct, including the improvementof foreign judgments, compilation of technical reference for supervision and theestablishment of relief system, and etc.The conclusion part is mainly on the future prospects. The author thinks that thecriminal case instruction system will make enormous contribution to providing thelegal construction of our country, improving the law and the creating a harmonioussociety. |
