The frequent increase of cross-border nuclear damage accidentsarising from Civilian nuclear facilities and activities has broughtirreparable damage to neighboring countries and even the whole world. Howto relive and remedy such damage has become one of the key issues ofinternational community. However, due to lack of effective regulation ofinternational treaties and customary international law in this regime,affected countries and personal victims can’t get effective compensation.This thesis emphasizes that International Liability for InjuriousConsequences are necessary in the nuclear liability system and introducessome advices on how to improve the nuclear leaking international liabilitysystem through systematical analysis on this international liabilitysystem. This thesis is divided into the following five parts: The firstpart is introduction, introducing the backgrounds, researching value&purpose, researching scope and structure of this paper. The second part,the first chapter, introduces the theoretical system internationalliability for injurious consequence in detail, comparatively analyzestraditional national liability&international liability for injurious consequences and then introduces some main controversial points of viewon this responsibility system present. Chapter2is the third part, whichanalyzes the legal basis&principle of liability attribution ofinternational liability for injurious consequence, emphasizes that weshould apply the principle of strict liability to this internationalliability system. The fourth part of the paper, the third chapter,detailed presents the compilation and development history of UnitedNations International Law Committee and the existing internationalconventions on nuclear damage liability. The fifth part is the fourthchapter, advising on how to improve this international liability systemas well as how to improve our country’s nuclear liability system inaccordance with the analysis of the realistic dilemma of reimbursementarising from nuclear damage.
