The right to life is the basic right of human beings and also is the foundational right of all rights. The protection of the right to life has been confirmed in the legal field internationally. As for legal the safeguard of the right to life, our country has done something, but what we’ve done is far from enough, which is reflected in many fields, such as legislation, enforcement and justice. The research on the safeguard on of the right to life by laws will be a great advantage to the establishment and improvement of our harmonious society.In this thesis, the safeguard of the right to life by laws will be discussed. The historical development and current situation will be compared between home and abroad by starting with the analysis of the basic concept of the right to life. Some relative problems about the protection of the right to life will also be discussed.The main body of this thesis can be divided into four chapters. The first chapter analyzes the basic information of the right to life, discusses the contents, the subject and the nature of the right to life and compares it with other relative rights, which can make the readers understand the right to life clearer. The second chapter introduces the development of the right to life home and abroad, and analyzes some obstacles on our way to improve the sense of right to life in our country and the reasons to them. The third chapter mainly discusses the state obligation of safeguarding the right to life and our current condition of the law safeguard on right to life, and points out some shortage on the constitution and department laws for safeguarding the right to life, and gives some advice on how to improve them. The forth chapter discusses some important relative issues to the right to life. Last but not least, the safeguard of right to life cannot be realized by any single method. The safeguard by law is no exception. Besides it, some other methods to safeguard the right to life should be take, such as the improvement of the social security and the increasing of the international communication, etc. Only in this way, can the right to life be safeguarded more effectively and efficiently.
