The exclusionary rule for illegal words evidence is a rule of evidence that standardizes the qualification of evidence, whose central question is to define its effect. Because of its own value of lawsuit and unique role in criminal suit, this rule is adopted by most of countries in the world, and turns into a criminal judicial standard of UN. This thesis compares the different modus operandi of legislation and legal theory between the countries of Anglo-American and Continental law system; analyzes this rule’s present situation of legislation, judicature and the fundamental research in our country; improves this rule and establishes related procedure systems and supporting systems.
