With the rapid development of the economy, especially the rapid development ofindustrialization, the environment problem is becoming more and more serious, at the sametime, more and more people begin to pay attention to the environmental problems, people’senvironmental protection consciousness rise ceaselessly,more and more people chooselegal means to struggle with the environment damage behavior, use legal means to protect theenvironment public interest. The environmental monitoring and the environmental damagejudicatory appraisal is one of the important parts of environmental protection, and also isthe basis of environmental management and the environmental control, even be the legalbasis, environmental monitoring and identification accuracy affects the decision-making ofenvironment and environmental damage cases in court. Therefore, we should analyze thelegislative situation at present of the environmental monitoring and the environmental damagejudicatory appraisal which are related to the EPIL.,fine out the the flaws and shortcomings, toimprove the systems of the environmental monitoring and the environmental damagejudicatory appraisal and the environmental monitoring fees and appraisal fees,hope for it isusefull for the EPIL construction, thus to solve the environmental cases timely and fair, toprotect the ecological environment. To find out our country at present the flaws andshortcomings, to improve environmental monitoring and environmental damage judicialidentification and environmental monitoring fees and appraisal fees system, with a view to theenvironmental public interest litigation system construction is good to have benefits, thusmore timely and fair solution to environmental cases, the protection of ecologicalenvironment.
