Land is a farmer subsistence. Defending peasants’ rights and interests is protectingtheir basic right. Our government is always emphasizing peasants’ legal rights,especially the equal rights between men and women. But in reality, the fact thatwomen have little farmland is a serious proble, which is a common phenomenon. Withthe rapid development of urbanism, the number of married women who have no landright is increasing fast, especially in those rual-urban fringe zones in Chen zhou, Hunan Province. Social contradiction is becoming more and more sharpen,fierce anddiversified. It has a bad influence on fairness. What’s worse, it may result in anunstable society. So the women that have little farmland right is drawing everyone’sattention.This problem contains different kinds of reasons, including historical and socialfactors, aslo system and individual can be included. And farmland policy that landbelongs to the country, but it can be used by individuals effects women’s right. Thereis no guarantee for women. In Chen zhou, Hu nan, because of marriage, many womenlost their original land right. Nowadays, with the ineasing of non-agriculturaldevelopment, how people get their income is becoming diversity; in the meanwhile,more and more peasants set foot in other cities to make a living. So the function offarmland is becoming weaken. At the same time, once housing land and cultivatedland are sold, menfolks can benefit a lot, while femals get seldom even nothing.Although laws protect women’s rights and interests, it pays little off. If we want toinsure married women’s right, we must get help from legislation, administration,justice, ect.This essay analyses the present situation factors and related cases of thisphenomenon, then lists some target-oriented, practical and operable solutions.In this article, it discussed that if we want to achieve equal rights between menand women, we must increase law awareness, regulate the behaviors of the Villagers’Committee, and find a balanced point between traditional custom and moderncivilization. We should deepen the reform of rural land contract system, make sureeach married women have equal rights and interests.
