The coming of the era of globalization makes the corruption show the trend ofinternationalization. The growth and spread of corruption has become the world’shazardous problem faced by all countries. Nowadays, both developing and developedcountries are all plagued by the corruption, no matter capitalist or socialist countries.Corruption will be one of the world’s greatest challenges faced by the world in thefuture.In2003, the fifty-eight United Nations General Assembly deliberated andapproved the United Nations Convention against Corruption, which will be taken intoeffect in2005. And how to make it truly effective was increasingly becoming thefocus of all countries. National anti-corruption agencies were looking forward toestablishing an independent, specialized organizations to promote mutualcommunication, enhance practical cooperation. IAACA was set up under theconditions, its establishment played an important role in prompting world’santi-corruption work intensively in the furture.This paper makes a study of IAACA from the perspective of InternationalOrganization Law. Through the observation and studies of establishing backgroundand process of IAACA, and analysis of properties and legal statues of IAACA, thispaper first outlines the overall IAACA. This paper described and analyzed IAACA’sconstitution, i.e. the Articles of Association, the author proposes to increase the"favorable terms" principle and the "consensus" principle in the application ofmembership and voting procedures. This paper focuses on the foreign functions ofIAACA, and analysed it combined with more than four years’ establishment ofachievements and weaknesses. On the basis of research on anti-corruption measuresof other international organizations, IAACA should be improved in four areas, i.e. toestablish an information exchange mechanism, to strengthen the technical support ofanti-corruption agencies, to make full use of the effect of the media, and to improverelevant laws and regulations. Finally, this paper discusses the relationship betweenChina and IAACA. As the Presidency of IAACA, China should spare no effort topromote its development, prompt IAACA to play its due role in the field ofinternational cooperation against corruption.
