Research On Legal Issues About Chinese Rural Environmental Tort

In recent years, people pay more and more attention to the environmental issues. In the Seventh National Environmental Protection General Assembly, Vice Premier Li Keqiang pointed out that it is important to provide the people with a clean livable well-being. According to China Environment Bulletin, our urban environment is improving and rural environmental issues have become increasingly apparent. In such a context, the research of rural environment is very practical. This paper mainly focus on the interests of victims and the protection of the rural environment, the regulation of the civil law perspective. We do the research in the infringement of the rural environment.The first part is an introduction to the infringement research background and current situation of the rural environment. Also, it contain the purpose, the meaning and simple introduction of the paper.The second part is an overview of the infringement for the rural environment on the implications and characteristics of the rural environment tort. We analyze the causes and consequences of the infringement of the rural environment. In one hand, we did this for rural environmental tort civil legal problems lay the foundation for the study, on the other hand for the rural environment tort relief of the bedding.The third part of the article is the research in Japan and the United States on solving environmental tort issues which related to civil legal relief system. Mainly on the civil relief of the environmental tort, environmental tort damages system, the environmental public interest litigation system are studied. We did this for our country rural environmental tort civil relief system.The fourth part of the article is on Chinese rural environmental tort legislation current situation and the rural environment tort that invoke IPR protection law. Also, the paper pointed out that there are still problems in a rural environment and the necessity of Chinese rural environmental tort civil legal relief.The fifth part of the article is about the solution of our country rural environmental tort problem, mainly from the rural environment tort legislation mode selection, construction of rural environmental tort law system, perfect the relevant legal content and relevant civil legal system respect to undertake exploration. After the analysis, for the rural environment tort legislation mode selection, we appropriate to the current legal system, content undertake corresponding adjustment and modification as a transition. On rural environmental tort civil legal content aspects, we did the research mainly from the rural environment tort civil responsibility, liability and relief to the several aspects. In addition, there is also a need to establish the corresponding system of civil law, to safeguard our country rural environmental tort law to carry out effectively, cogent safeguard to be infringing human rights, protect environment.
