Traditional Chinese medicine (TCM) is the major element of our traditionalculture, occupies a significant advantage in the international arena. However, with thedevelopment of economic globalization, the global biodiversity and cultural diversityhas been a serious threat. Due to the particularity of Traditional Chinese medicine andour thorough study of TCM intellectual property issues, the protection does not reachthe designated position that many traditional Chinese medicine knowledge wealthlosses or be held; the traditional advantage field of traditional Chinese medicine inChina also faces all sorts of challenges. In the face of Western medicine continue tostrengthen its scientific and technological advantages through the modern intellectualproperty system, we have to think about: how to use modern intellectual propertysystem to promote the sustainable development of traditional Chinese medicine?Theoretically depth study of traditional Chinese medicine the necessity and feasibilityof the protection of intellectual property, defects by combing traditional Chinesemedicine the status of intellectual property protection, intellectual property protectionof TCM, to learn from foreign legislation, based on China’s basic national conditions,China Chinese medicine protection of intellectual property rights way to put forward abold proposal, and an important reference value in order to develop appropriatepolicies of our government.This article mainly consists of four parts in addition to the introduction andconclusion. The first part is a brief overview of the traditional Chinese medicinewhich is mainly introduces the characteristics and the feasibility of patent protection.Through the introduction of the second part of the United States, Germany, France,Japan and South Korea several countries about traditional Chinese medicine theprovisions of the patent system, so that in comparison to the traditional Chinesemedicine patent protection for analysis. The third part is the status of traditionalChinese medicine patent protection, problems, and genetic analysis, and highlights theexisting problems of TCM patent protection, then come to the cause of this problem through a comparative analysis. The fourth part is how to perfect our country’s patentprotection system of traditional Chinese medicine, traditional Chinese medicine forthe protection of intellectual property rights to provide some Suggestions.
