China’s criminal law stipulated that intentional homicide means illegally deprivedlives of others. Include of single intentional homicide and more than two peoplesintentional homicide. The judicial organ will according to the offender’s serious level todetermine sentence the offenders to death whether or not. Compared to the singleintentional homicide, More than two peoples intentional homicide has its owncharacteristics, is that when only make one person death, but sentence two or morepeople to death. Under the current circumstance, according to our country’s criminalpolicy, when judicial organ hearing a death penalty cases, they must serious toimplement "leniency and strict" criminal policy, insist on "less killing and careful tokill" principle and so on. Especially in jointly murder cases, judicial organ must strictlyenforce the law、impartial judicial, strictly distinguish offenders position and function inthe jointly murder cases, determine sentence the offenders to death whether or not basedon comprehensive analysis, cant sentence the offenders to death without distinguish. Myarticle introduce the concept of intention homicide and jointly murder, analysis somereality factors that affect the application of the death penalty, and analysis the trial resultof YuanBaoJing case and WangWenXiang case form different point of view, elaboratemy view, at the end, according to the current criminal policy, summarized thefoundation and boundary of the application of the death penalty. The study of my articlenot only make me have a better understanding of the application of the death penalty injointly murder, but also provide some reference value to other research on theapplication of the death penalty.
