The Filing Status Quo Research Of Civil Action

The case-filing review system in our country is the primary threshold of civildispute entering litigation,and is also a key point on the performance of parties’ right ofaction. Its system design will directly influence the realization of the parties’ right ofaction and substantive rights.It has significant meaning to resolve the problem of“difficult action”,to resolve social dispute orderly and to pretect basic rights of citizens.Aiming at the phenomenon on “difficult action”, this artial firstly analize the causeabout the case-filing review system in our country,including the high requirements ofaction, the narrow scope of civil case about court and so on.Then,from the basic theorysupporting the case-filing review system in our country, we shuold reflect the seriousdefaults and shortcomings in China’s current system of suing, the lack of supportingsystem,including method of performance appraisal in bad influence in court, lack ofsupervision.At last,the suggestions of this article are follows: transforming thecase-filing review system in our country from entity review to form review, expandingthe competent range of civil action about court, establishing the principle of finalsettlement about judicial and perfecting the ADR.
