Mongolian is the eighth largest minority in China, with a long history and rich ethnic culture. Mongolian ecological customary law is one of the outstanding ethnic cultures, which is accumulated continually in the course of Mongolian historical development. It includes the customary law of the grassland protection, water conservation customary law, customary law of forest resources protection, customary law of animal and plant resources protection, playing an essential role in environmental protection and construction of the Mongolian region.In this paper, China’s Mongolia ecological customary law is mainly discussed with the methods of literature analysis, comparative analysis, inductive analysis, examples and illustrations etc. It is divided into five parts.The first part, the author summarizes the theories of Mongolian ecological customary law, introduces concretely the current situation of Mongolian ecological environment, the origin, characteristics and effectiveness foundation of the Mongolian Ecological customary law.The second part, the author discusses the extensive and rich content of Mongolian ecological customary law by taking and analyzing examples, including customary law of the grassland protection, water resources protection, forest resources protection, animal and plant resources protection, as well as other ecological customary law in five aspects.The third part, the author analyzes the effectiveness of Mongolian ecological customary law from two perspectives of the social efficacy and standard efficacy. The social effects mainly include maintenance of the order of the Mongolian environment, protection of Mongolian internal equity and justice and passing the Mongolian ecological culture. The standard efficacy is mainly reflected in guidelines and evaluation functions of the environmental protection, the mandatory role of the breach of the ecological customary law, as well as the prediction and educational role of Mongolian conducts.The fourth part, the author specifically addresses the difficulties of China’s Mongolian ecological customary law. It mainly includes the following aspects: firstly, the rise of productivity has had an impact on the Mongolian ecological customary law; secondly, the adverse effects on Mongolian ecological customary law created by China’s market economy system; thirdly, national integration causes desalination of Mongolian ecological customary law; fourthly, the negative impact of some of the negative factors of Mongolian ecological customary law; fifthly, there is a conflict between Mongolian ecological customary law and China’s environmental legal system.The fifth part, the author explores the development Solutions of the Mongolian ecological customary law corresponding with the difficulties faced by the Mongolian Ecological customary law, hoping to be beneficial to the development of Mongolian ecological customary law and ecological protection of Mongolian regions. First of all, we must face squarely the exist of Mongolian ecological customary law; Second of all, we should emphasis on the protection of the Mongolian traditional ecological customary law in the process of national integration; moreover, we should make full use of modern scientific and cultural knowledge to get rid of the outdated concept of Mongolian ecological customary law; most importantly, we should make an effort to promote the integration of Mongolian ecological customary law and China’s environmental legal system.
