In recent years.in some international areas including the WTO dispute settlement mechanism.amicus curiae intervented in the proceedings of the case,not only the quantity increases day by day,but also the impact of growes.Amicus curiae originated in Roman law, British court in the judge trial practice introduced early into England,and later transplanted into the United States and got a lot of development. Set the purpose and value of the system lies in the amicus curiae not yet mastered the facts of the case or legal advice to the court,in order to enable the judge to make a fair and reasonable decision.and this system embodies the spirit of democracy in the activities of the administration of justice,more conducive to increasing the authority of the judiciary and enhance public trust.The first part of this article based on the analysis of the concept of the amicus curiae in different nations.then summarizes the relevant elements, finally defines the concept.Amicus curiae in the WTO dispute settlement mechanism from in light of practice.there is a certain practical significance for China who have had jioned WTO for ten years.Through to amicus curiae in countries of Anglo-American law system and the dispute settlement mechanism of WTO development course and characteristic analysis.this article proposes our country should adopt specific measures and recommendations,guidance in China in the WTO dispute settlement mechanism in practice to make more conducive to their own action.Finally,this article on WTO dispute settlement mechanism is introduced in the amicus curiae validity evaluation and our treatment of the dispute settlement mechanism of WTO amicus curiae attitude.
