Analysis On Alternative Dispute Resolution

Contradictions penetrate in the entire process of social development, so it is verynecessary to establish a set of perfect and reasonable dispute resolution mechanism.Atpresent，our country is working to build a socialist harmonious society and buildinga socialist country ruled by law，while at the same time our country is in a transitionperiod of rapid change，social conflicts and disputes on a variety of increasinglyprominent．Faced with a wide range of social changes and conflicts of interest，thetraditional dispute settlement mechanism has exposed the growing number of itsinherent defects. So Alternative Dispute Resolution received extensive attention for itsunique flexibility by the national law experts and the field of judicial practice.Although China is carrying out the socialist concept of law, But compared withwestern developed countries. The construction of law in China started late, the level isrelatively low, and do not form a unified concept of the rule of law and legalawareness, In this case, researching and using alternative dispute resolutionmechanism has important theoretical significance and practical value. In this paper,author first discussed the basic theoretical issues on Alternative Dispute Resolutionmechanism, and inspected American and Japan in which the rule of law is moredeveloped. Analysis efforts we should make for the improvement of China’sAlternative Dispute Resolution mechanism.
