The Research Of Administrative Adjudication In China

To solve this kind of special civil disputes, administrative adjudication has played an important role in the solving of social conflict. These advancement have made the administrative adjudication became vivid and advanced. However, it is a lot of reasons that has reduced the sufferance and usefulness of administrative adjudication:the shorted-research time, none-focused power and insufficient practice experience. So how to build a so-called Chinese administrative adjudication is an important task for the law area. My article divided into three parts that has played different role in the whole research. The first part has introduced the meaning of the administrative adjudication, which looked from the industry and the nature. Then, the second part says the insufficient of the administrative adjudication, like the rages of the administrative adjudication is fuzzy; the administrative office is unprofessional and the relief of the administrative adjudication is not enough. From the saying above, there are some experience of foreign country have been introduced in the article, which also pointed what is the core part of the administrative adjudication. The most important part is the last part, which involves the author’s opinion of the topic. Firstly, to make clear the rages of the administrative adjudication; Secondly, to let the people of the administrative office more professional; Thirdly, to refine the rules of the administrative adjudication; Lastly, to establish the relief of the administrative adjudication, which including the administrative reconsideration and the incidental civil litigation.
