Study On Legal Risks And Prevention Of International Freight Forwarders During The International Coorperation With Overseas Agents

In modern international logistics, international freight forwarding enterprises play a very important role as the essential exists for service of international trade. With the continuous development of international freight forwarding industry, international freight forwarding agent engaged in the freight forwarding business change from the original simple international freight forwarder to dual role as an international freight forwarder and carrier. International freight forwarding companies can engage in the freight forwarding business, and as the carrier with certain qualifications, has the rights and obligations of the carrier.The nature of International freight forwarding business is shipping the goods from the departure of exporter’s country to the destination of the consignee`s country. International freight forwarding companies are often not familiar with the laws of the foreign country. And it is often difficult to do business in the foreigncountry. In order to achieve commercial purposes, freight forwarding companies u sually need to cooperate with overseas counterparts. The counterparts of these overseas international freight agents are overseas agent.Cooperation with the overseas agent is often not smooth. In the absence of proper risk precautions, many freight forwarders are involved in disputes during thecooperation with overseas agents, and even suffer undue losses. Although the freight forwarding business in the actual course of doing business can not completelyavoid the risk, but lots of risks generate because the enterprise’s own operations are not standardized or are not familiar with the relevant legal system. Freight forwarding companies in cooperation with the overseas agent should be aware of the legal system involved in the process of cooperation, while regulating their own behavior in order to reduce their risk.In view of the domestic freight forwarders face a wide range of legal risk, this paper will analyze the legal risks in the business cooperating with overseas agents,and prevention.This paper is divided in three parts. In the first chapter, this article will be international freight forwarders, as well as its overseas agent for the basic exposition, including international freight forwarder in the role of agents with overseas cooperation, as well as overseas agents and the basic situation. In Chapter II of this article, the article will demonstrate, in cooperation with the overseas agent, the legal risks faced by the freight forwarder in China, including the proxy risk of legal relations, the legal risks of the agency contract content and business development of specific legal risk. In this chapter, the article also refers to some cases to visually show these risks and losses caused by domestic freight forwarders. In the third chapter, as second chapter discusses the legal risks are analyzed, specific preventivemeasures are given in the third chapter. I hope that through the study of these risks and preventive countermeasures to provide some information and reference for domestic freight forwarding companies.
