Comparative Study On The Sunset Review Of Anti-Dumping Between The European Union And The United States Of America

Sunset Review, also known as Expiry Review or5-Year Review, is an administrativereview procedure initiated by anti-dumping overseeing institutions itself or at therequest of the interested party within5years of the implementation of anti-dumpingmeasure to review whether such measure should expire or not. This system, being oneof the important outcomes of the Uruguay Round, plays a positive role in reasonablylimiting current anti-dumping measures, regulating international trade system andcreating fair international trade environment.The Sunset Review System has just been introduced into China for a few years andthe legal system of the Sunset Review is relatively simple. In addition, the importancescholars of our country attached to the Sunset Review is far less than that to theoriginal investigation and the substantive measures of the anti-dumping not to mentionthat the research achievements specifically on that area it is extremely limited.Therefore, we must figure out the ways to improve the Sunset Review of our countryunder the regulation framework of WTO in order to further protect the interests ofour domestic industries.This paper consists of three parts: Part Ⅰ General Description of Sunset Review System of WTOThis part mainly describes the evolution of the Sunset Review System and itscontents. It also comments on the meaningfulness and weakness of the Sunset ReviewSystem of WTO.Part Ⅱ A comparative study on the Sunset Review System between the EU and theUSAThis part explains the Sunset Review System in the European Union and the UnitedStates respectively, compares and analyses the recognition standards of thepossibility of dumping and damage in Sunset Review System of the EU and the USA. Italso compares and contrasts the legal practices in the respective systems byillustrating relevant cases.Part Ⅲ Inspiration from the Sunset Review System of the EU and the USAThis part introduces the evolution, current practices and weakness of the SunsetReview System in China, and gives suggestions to improve the Sunset Review System inChina.Sunset Review System is not only an indispensable part of anti-dumping legal system,but also an important measure to protect domestic industrial and national interests.As the Sunset Review in China is not yet complete, therefore it is necessary for ourcountry to learn from the advanced legislation and ample practices of the EU and theUSA to establish a relevantly complete Sunset Review System in China within theworkable domain so that a good trading environment can be created for our domesticindustries.
