On Interpretation Of The European Union Treaties

Now as the most influential regional international organization in the international community, the generation and development of European Union has always been need the support of the European Union treaties.The European Union treaties constantly drive the development process of European integration in the legal level. In judicial practice, the European Union treaties have often been applied, and in the process of the application the legal interpretation of the European Union treaties become a necessity because of the presence of a variety of internal and external factors. From a macro level, the article discusses the interpretation of the European Union treaties, and by comparison with the other international treaties we can see the particularity of their interpretation. The particularity of their interpretation is both a development of traditional treaty interpretation theory and has a positive reference to the other international organizations in the world-wide.In addition to the introduction and conclusion, the article is divided into three chapters. Chapter Ⅰ expounds the interpretation of the European Union treaties in general, and introduces the overview of the European Union treaties, the theoretical basis for the interpretation of the European Union treaties, as well as the subject and the start program of the interpretation of the European Union treaties, and other related contents. Chapter Ⅱ elucidates the basic principles and the specific methods of the interpretation of the European Union treaties, and this is the focus of this article.Before describing their principles and methods, this chapter focuses on the traditional theory of treaty interpretation and the terms of Vienna Convention on the Law of Treaties. Besides that, this chapter also analyzes the basic principles of interpreting in a good faith and a uniform interpretation,at the same time pointes out the specific methods of the interpretation of the European Union treaties. Its ways include semantic interpretation, historical interpretation, systematic and teleological interpretation, and comparison interpretation. In the summary of the basis of the first two chapters Chapter Ⅲ describes the particularity of the interpretation of the European Union treaties,and concludes that it’s because of a variety of factors. At the end of the article it expounds the important role of European integration of the interpretation of the European Union treaties.
