Criminal legal aid system refers to a system that provides free legal services to people otherwise unable to afford legal representation and access to the court system during criminal law suits. Legal aid system is established to provide access to justice in criminal and other law suits so as to safeguard the legitimate interests of people in spite of their financial difficulties. In addition, Legal aid system will help ensure equality before the law. This system has become mature in the western world, and it is gaining more and more emphasis from the state and government in China. However, as the legal aid system started only from the middle of1990s in our country, it needs further reform and great improvement. In recent memory, with the emphasis from the Chinese authority, the legal aid system has been improved and it is playing a more important role in promoting harmony in the society. However, there are still many problems to be addressed. At present, if we are complacent about our achievements and stop improving the system, all the results we have achieved will be meaningless. Therefore, we must persist in improving the system and solving the problems emerged in its development. Only in this way can the legitimate interests of those in need be protected. In this paper, I analyzed the problems of China’s legal aid system and introduced my perspectives on these problems, wishing to contribute to the improvement of China’s legal aid system. The paper is consistent of three main parts—the introduction, the main body and the conclusion.In the main body of the paper, I first presented the brief introduction of the criminal legal aid system, including the analysis of its definition, features and its significance.In the second part of the body, the shortcomings and problems of China’s criminal legal aid system was discussed. For example, the covering scope of the system needs to be expanded; lawyers’ interventions come too late in the process; the legal aid fund is yet to be guaranteed; the system lacks of a unified system and implementation mechanism; the quality of legal aid services need to be improved as well as other problems.The last part was centered on the possible solutions to the above-mentioned problems. The paper argues that the China’s legal aid system should be improved in the following aspects:the scope of legal aid services should be expanded; legal assistance is required during investigation phase of the law suits; fund injection is needed; a comprehensive system for legal aid should be established and the quality of legal aid service needs to be improved.
