Manufacturing Of Migrant Workers Labor Rights And Interests Protection Law Countermeasures

Peasant worker is a new labor force in the deepening of reform and opening-up and the accelerating of industrialization and urbanization. Although they are fanners, they are engaged in non-agricultural labor as the main source of life. They live in the city, but failed to integrate into the city; they left the countryside, but keep in touch with the country. The city can not do without them, but discrimination, exclusion of them. They pay the labor is much, get in return is less. Unfair treatment to peasant worker causes a wide range of community concern, which is contrary to concept of China’s harmonious society, and brings great risks to the social stability and development.According to the legal theory of democracy, freedom, equality, human rights, reason and civilization, and the rule of law, and based on the research on manufacturing peasant workers of a Science and Technology Park, I analysed·the present situation of manufacturing peasant workers, such as the lives, work, labor protection and other aspects. And I summed up some characteristics that manufacturing peasant workers have. They are younger, and they received a higher cultural education relatively and hope to live and develop in the city. And I made an in-depth analysis of the problem and reason in the protection of the peasant worker. There are three main aspects:(1) Long working hours, bad working conditions and less entertainment;(2) Disadvantaged with low income;(3) Higher contract rate, but they are the dispatched workers;(4) Lack of social insurance;(5) Low degree of organization;(6) low human capital circumstance. The reasons for these problems are not only peasant workers have low education and low quality, but also the imperfect law and system and inadequate government supervision. According to the characteristics of peasant worker and the problems of labor rights protection, combined with the social system characteristics and social conditions of China’s socialist countries, the paper gives some suggestions to maintain the rights of peasant workers:(1) Improve and implement the social insurance system for peasant workers;(2) Enhance the intensity of trade union to protect the right of migrant workers;(3) Increase the training education efforts for migrant workers;(4) Pay more attention to maintain the rights of the migrant dispatched workers;(5) Strengthening the government supervision and form the responsibility system of protecting the rights of migrant workers.Manufacturing migrant workers is a young group which is a part of the main forces of the urban industrial workers. Protecting their labor rights and interests is useful for the protection of the productive forces of socialist construction, and is an important aspect to improve government ability of administration, and is as the proper meaning of the socialist legal construction which is based on the concept of human rights and justice.
