With the rapid development of international food trade since China’s accessto the WTO, the supervision of food safety becomes more and more important. Weare facing such complicated issues as inspection of foodstuffs, the equivalence of foodinspection laws and regulations, and risk assessment. Inspection plays a key role inimport and export management of foodstuffs. As far as international level isconcerned, China’s import and export food inspection is directed by the relevantWTO agreements, mainly―TBT Agreement‖and―SPS Agreement‖; and in view ofthe domestic legislation situation, China has constantly promoted the construction ofinspection legal system for the imports and exports of foodstuffs, and alreadyestablished a mutual supported legal framework under the latest Food Safety Law.However, the application of China’s food safety regulations are still in transitionphase, and has not been in full harmonization with each other. The introductions anddiscussions in this paper focus on inspection legal system of China’s imports andexports of foodstuffs, and analyse the defaults and constraints of China’s legal systemof food inspection, and finally put foreward some proposals relating to improvementof China’s inspection legislation.
