Economic compensation system for divorce is used to balance the economic benefitbetween the husband and wife when they divorce, the purpose of this system is to protectthe party’s interests who has made a greater contribution to the family during the existenceof their marriage, to realize the justice of the legal.There are three parts: introduction, body and conclusion in this thesis, of which thebody is divided into four chapters.The introduction mainly elaborates the background and time of the economiccompensation system for divorce, and makes a simple exposition for the views of scholarswho advocates,and then puts forward the importance of this paper.The first chapter begins to analyze the basic theory of China’s economiccompensation system, and then discuss the possibility and necessity for our country toexecute the compensation system for divorce, as well as the exercise of right of claim foreconomic compensation condition and the significance.The second chapter analysize the legislations of Germany, Switzerland, the UnitedStates,Hongkong and Taiwan regions, draws on the enlightenment for our legislationpractice.The third chapter is mainly about the practice of our country in the present judicialproblems from the scope of applicable, exercise time, the amount of compensation and thevalue of household chores evaluation this four aspects.The fourth chapter puts forward by expanding the applicable scope, extension ofeconomic compensation request right and the duration of time, increasing the amount ofcompensation related factors, to improve the economic compensation system of therelevant provisions of other methods to improve our economic compensation system fordivorce, and expectations the system in China will be better implemented.The last section gives a brief summary of the conclusion and significance.
