Notarization is the act to certify legal acts, the facts with legal significance, the authenticity and validity of legal instruments, which is done by means of issuing a notarial certificate. For the purpose of ensure the legitimacy and authenticity of notarial certificate, and then guarantee its effectiveness, it is necessary to provide corresponding true and legal proofs. Illegal and untruthful proof means the notarial contents are illegal and invalid, thus leads to the null and void of document. The process of notarization is actually the process of collecting, examining and confirming of notarial proofs, and examining is the most basic and nuclear one, which is the key of notarizing a fact. In other words, notarization centers on the investigation of notarial proofs.Except introduction and conclusion, this paper is divided into four parts.Part One, as the examining manners determine the range of investigation, it is essential to briefly introduce the theory basis of notarial investigation manner. Chapter one introduces foreign notarial investigation manners, the regulation of examining range and practice, and then mainly illustrates the examining manners in China, regulations on the examining range of proof as well as the understanding of scholars.Part Two focus on the principles of notarial proof investigation, and then makes a deep analysis on the authenticity and legality principles of notarial proof.Part Three analyzes the problems existed in the practice and system of notarial proof investigation in our country.Part Four proposes corrective recommendations aiming to the problems mentioned in Part Three.
