Research On The Legal Regulating Of Policy Banks

It has been discussed for years that the problem of Policy Banks’ legal regulating.But there’s no real sense of Policy Banks’ legislation at present in China.First, this paper discusses not only the concept and contents of policy-based finance, policy banks, policy financing, the interrelationship between them but also the differences between policy banks and commercial bank. Then introduces the significance of policy banks and concludes that our country still need policy banks.Secondly, the emergence and development of policy banks and the feature of foreign legislation was discussed. Contrast, discusses the emergence and development of the China Development Bank, the Export-Import Bank of China and the Agricultural Development Bank of China. Then points out the problems exist in China’s policy banks.The third part of this paper discusses the necessity and feasibility of policy banks’ legal regulating. And concludes that policy banks’ legal regulating is necessary for us to perfect the financial system, to normalize the operation of policy banks and to have policy banks functioning optimally. And concludes that it will work.Based on the analysis of the current situation of the policy banks’ legalization, constructing the framework of the basic contents of policy banks’ regulating in China. And points out that the legislation of policy banks should be formed in a separate legislation.The last part of this paper based on the above analysis, put forward some strategies to advance the policy banks’ regulating in China by analysing the changes in international policy banks and taking the China Development Bank for example to state our country’s policy banks’ reformation. These strategies mainly includes corporate legal person management system, internal control mechanisms, market access system and the withdraws, risk management system, outside supervisor system, performance valuation system and so on.The main contributions of this study lie in that detailed analyses the policy banks’ legal regulating in China make use of the theories of law and economic. The alternatives designed in this paper can provide scientific references for our country’s policy banks’ legal regulating.
