To face the increasing intense competition of international economy, every country in the world has raised the tide of the reform of the civil service system in order to improve government management capacity. At present the discussions of civil servants’ retreating mechanism is in the primary stage and results of research are scattered, especially lack of obstacles to deeply analyze and macro sure, so they could not get the effective analysis. Overseas study has its own characteristics and other countries’ political system and social development to the Chinese have a huge difference. But the study of the civil servants retreating system of Taiwan area has been50years, which was called "the civil servants severance system". In view of the relatively perfect civil service severance system of Taiwan area and similar with cultural background mainland area, we should put the civil servants severance system and Chinese details together.The paper is divided into four parts:The first part is the definition of civil servants severance system in Taiwan, which includes the meaning of the civil service severance system in Taiwan and the difference between Taiwan civil servants laid off system and related systems."Severance" is a kind of civil service departure, exempting from civil service positions, but not civil service status by severance. Severance refers to a departure system, when the civil services meet the elements of severance, individuals apply for it initiatively and authority leadership approve of it. Individuals can get a certain amount of severance pay or comfort grant after changing positions. Governments will preferential policies to encourage the severance. Most of the severances are based on voluntary; less o the severances are based on mandatory. The result of severance, the punitive dismissal, stopping alternate dismissal, stopping a trial separation and dismissal of punishment can lead public servants to removal from office and stop his duty effect; however, stopping alternate dismissal and stopping a trial separation refer to those who neither qualified for work assessment, nor accept the elimination of any actual work of public servants due to fail during the trial.The second part is the design and implementation status of the civil service severance system in Taiwan, including the design of civil service system, and implementation status of the civil service severance system in Taiwan. In a fundamental sense, civil service severance system in Taiwan has become a retirement system, from the creation of the toll mode, to retirement in accordance with the seniority and other public servants, sending severance costs in the form of pension. But the purpose of the legislation at that time is mainly to make up the deficiency of the retirement system, the civil services below the legal retirement age leave for severance pay ahead of the public services, in order to streamline the effect of personnel, improve the organization and work efficiency, promote the benign circulation of the personnel work and the personnel management, strengthen the authority of the leadership, solve the difficulty of personnel work, keep the elasticity of the employing the authority, and make the agency leadership cannot be competent for civil services work of the staff with legal basis of purpose. The severance of civil servants is classified into three circumstances:authorities downsizing, work change, incompetent the work, without the post work or without proper work to transfer, according to the hospital proving the officials don’t adapt to the severance. The identity of the civil servants belongs to the control of the examination institute in accordance with relevant regulation. The examination institute makes some measures for civil service security, that is, training committee and management of civil service security. Security law of civil servants refers to those who are sent to the appointment for the specialized person in legal authority and schools, not including political officials and office personnel from electing. Although Taiwan civil servants streamline have made achievements, there are also certain problems: First, the severance pay and performance evaluation of civil servants can not effective combination, or can not play function of awarding actor discarding bad. Final inspection of rewards and punishment system can not implement, get the work goal, and lost its original function. It has also been counterproductive to government streamline. Second, there are some loopholes, for civil servants severance elements are not clear. We should strengthen the severance personnel’s determination standards, objective, fair and consistent with the principle of equality. Third, the civil servants are out frequently occurred, and the brain drain is lower down government service efficiency.The third part refers to civil servants severance system reform and assessment in Taiwan area, including the causes of the civil service system reform and experiences and enlightenment of development trend of severance and civil servants severance system in Taiwan. Through forced layoffs, government and civil servants signing target managements contract and implement market mechanisms. The traditional assessment system produced the fundamental change under a series of reforms and promotion of civil servants in developed countries. Especially in the increasing development of the market economy, the price form of cost and benefit has become the value of people. However effective operation of this price mechanism needs a scientific evaluation for civil servants ability and achievement as necessary condition. The aim of the civil servants assessment is to get the economic benefits in public management. The function of the government is gradually incline to market, competition mechanism fit in it reasonably, and the management of civil servants also needs the market price mechanism, the costs and benefits, therefore reflects the market. Decentralization is a useful way to improve the government service level. First, strengthen supervision, and eliminate abuse their power and discretion for the local government or leaders in positions which lead to corruption. Moreover, reinforce the construction of legal system, make full use of the moral and legal force, and improve moral and civil servants professional qualities of relevant personnel of government in order to avoid t the out of control under decentralization. Civil servants severance system of Taiwan is superior distinguished in the abolition of the civil service system, a perfect legal system, a strict execution procedures, and market-oriented reform of civil servants system construction.The last part is improvement of the civil service retreating system of China mainland, describing analysis on the status and the improvement of the civil servant retreating system of Mainland which includes five forms:retirement, resignation, dismissal, fired and contract expires system. The sluggish retreating system of civil service is the main reason of hindering the development of retreating system, and it makes bloated personnel, expanded organization and overstaffing situation. This paper mainly talk abut some advice on civil service retreating system from confirm forms of civil service retreating system, perfect assessment system, improve the supervision system and the relieve system of civil service retreating system of mainland.
