Talk About The Our Country Anti-unfair Competition Law Banning The Perfection Of Legal System Of Commercial Bribery

In this paper, with amendment perspective of “Law of the People’s Republic of Chinaagainst unfair competition”, the author comprehensively researched the prohibition ofcommercial bribery legal system. With historical materialism and dialectical materialismmethod, comparative analysis method and value analysis method, the author put forwardand elaborated own viewpoint in detail for the concept of commercial bribery, the mainbody of commercial bribery, the behavior of commercial bribery, the administrativeresponsibility of commercial bribery and the civil liability of commercial bribery. Thethesis is divided into seven parts. The first part, the author comprehensively analyzedpolitical risk, economic risk and social risk of commercial bribery. The second part, theauthor analyzed the prohibition of commercial bribery legal system in China and foreigncountries. The third part, the author defined the concept of commercial bribery. The fourthpart, the author researched the main body of commercial bribery, pointed out thedeficiency of law, and put forward legislative proposals with the main body of commercialbribery. The fifth part, the author comprehensively induced the behavior of commercialbribery in summary and researched related to the specific legal issues. The sixth part, theauthor pointed out the deficiency of law in the administrative responsibility of commercialbribery and researched the administrative responsibility for supervision mode, regulatoryenforcement means and administrative sanction. The seventh part, the author firstly pointedout the deficiency of law in the civil liability of commercial bribery and researched thecivil liability for liability method, subject of claim right and scope of compensation.
