Interrogation Stage Criminal Suspects Rights Research

Ours is the age of rights.Human rights is the idea of our times.Since the staterespects and guarantees human rights included in the Chinese constitution by theconstitutional amendment in2004,the protection of human rights in China has been ahot issue in different departmental laws,especially the criminal suspect’s right safeguardin the field of the criminal procedure law.During the interrogation stage, the criminal suspect is in the powerless position, asthe investigation organ having the authority of the law and the support of national force.With unlimited extension of power, the investigation organ wants to find out the factsand obtain the guilty evidences of the criminal suspect as soon as possible, causing theinvasion of the criminal suspect’s freedom, property and even lives.Though the rights ofthe criminal suspect have been stipulated in the criminal procedure law of our country,the rules are not perfect. And the phenomena of infringement the rights and interests ofthe criminal suspect in the judicial practice occur occasionally, in which some eventsseriously influence the justice image of our country’s judicature and cause irreparableconsequences of the society and nation, especially the litigants. This paper states theconnotation of the criminal suspect right guarantee and the comparison between ourcountry and abroad, indicates the deficiencies and the origins in our country, and finallyput forward own conception to safeguard the rights of criminal suspects.
