Since the1960s, the non-marital cohabitation phenomenon had become an inevitable phenomenon and gradually became a model of starting a family. It caused the attention of society and legislation of all the countries. Many countries have made legal regulation about non-marital cohabitation phenomenon. The non-marital cohabitation phenomenon do not become a very common social trends the same as the west, but it becomes a social trends without ignore. And the legal aspects of attention is relatively weak, and the legislation of non-marital cohabitation is scarce. It cause a lot of non-marital cohabitation couples with the interests of lose the protection, in particular the rights and interests of the weak part in the relation of non-marital cohabitation. Regulating non-marital cohabitation by the law that is the necessity of the reality, the need to protect the human rights, the requirements of the connecting of law and reality. In the paper, it draw the legislation experience from foreign, combined with the reality of our country, gives the relevant legislative proposals.The title of this paper is "Study of regulation for Non-marital Cohabitation". The content is divided into four parts, studying and analyzing non-marital cohabitation from foreign legal regulation mode and the legal system of non-marital cohabitation of our country.The first part, the overview of non-marital cohabitation. This part mainly expounds the concept and characteristics of non-marital cohabitation, some controversy about non-marital cohabitation in the academic circle and the difference with the other related concepts. Then, it examines the situation of non-marital cohabitation in the world and analyzes the reasons.The second part, the studying of legal regulation mode of non-marital cohabitation in the foreign. This part invests the legislative cases from United States、 Britain、France、Australia、Netherlands, and comments the advantages and limitation of foreign legislation mode.The third part, the reflection and consideration of legal system of non-marital cohabitation in our country. This part puts forward consideration and suggestion to legal regulation of our country’s non-marital cohabitation by analyzing our country’s legislative attitude about non-marital cohabitation and the evaluation of legal system.
