Research On Intellectual Property Protection Of Works Of Wooden-boarded Furniture

Wooden-boarded furniture is one of works of applied arts with utility and artistry.The enjoyment and the exercise rights of works of applied arts of members by “BerneConvention for the Protection of Literary and Artistic Works”,“Universal CopyrightConvention”,“Paris Convention for the Protection of Industrial Property” and “Trade-RelatedAspects of Intellectual Property Rights” such as wooden-boarded furniture and theprovision of related laws in our country are non-obvious. China protects this type of rightsby “Copyright Law” as works of artistic only in artistic nature instead of in functionalnature, laws on functional nature is inadequate. The assessment of value ofWooden-boarded industry will exceed Auto industry in2015which may become one ofthe largest industrial scale. At this stage of Chinese Wooden-boarded industry, plagiarismand shortage of protection by Intellectual Property Laws as a significant obstacle topromoting levels of Wooden-boarded furniture industry. The writer suggest thatWooden-boarded furniture industry shall be protect by double protection systems and hopea special law will be formulated to protect the domain of Wooden-boarded furnitureindustry in future. This article tries to improve the intellectual property system byprotecting works of applied arts, which make the internal of Intellectual Property Lawslogical.The Article composed of four parts：Chapter One: Introduce the definition and characters of furniture, works ofwooden-boarded furniture, and related intellectual property. Analyzes the purposes andvalue of article.Chapter Two: Introduce how the model of Bern Convention for the Protection ofLiterary and Artistic Works, Universal Copyright Convention, Paris Convention for theProtection of Industrial Property and TRIPs protect works of applied arts such as works ofwooden-boarded furniture.Chapter Three: Introduce how English, French, Euro-union and USA protect worksof wooden-boarded furnitureChapter Four: Introduce the practice of legislation and judicial in China, which is inadequate.Chapter Five: The key chapter of this article, the writer gives his own advices onprotection of works of wooden-boarded furniture by bi-law system, and analyze thepossibility protection model such as special legislation in protecting this type of works.
