In the60years, finance lease keeps being developed rapidly in the world after itwas generated; the penetration rate is30%. Finance lease is a kind of financingwayhasunique financial function with finance, trade, service which is honored as sunriseindustry and became the second largest financing way, after bank credit. In China,finance lease started relatively late. In2004it is applied to real estate industry as afinancing way. Due to the underdevelopment of finance lease, the practice offinancing lease with the wrong cognition and imperfection of legislation, theoperation of finance lease in real estate industry still has greater legal risk.First, his article introduces the basic theory of finance lease, including definitionand characteristics, types of finance lease and related theory knowledge in differenrfield. Second, considers real estate as the subject matter of finance lease, analyse thepresent situation of real estate finance lease and existing problems. With the operationprocess leads the risk of trade practice and analyse. The next, financing leaseregistration system of the United States and Germany financing lease contract formsthe lease item risks and so on is introduced. Have a acquaintance with the foreignsuccessful mode, combining the current situation of the development of China,referencing their successful experience.
