The Research On China’s Local People’s Congress Standing Committee Legislative Deliberation Procedure

Formation of China’s socialist legal system has proposed newrequirements to improve the quality of legislation. Local people’sCongress legislative review procedure plays an important role onensuring exercising legislative powers legitimately and achievingupgradation of the quality of legislation.This article takes local people’s Congress legislative reviewprocedure as the starting point, trying to make a systematical analysis ofthe relevant rules of a law and60local laws and regulations, and make acase study of the practical steps with methods of the combination ofempirical analysis and text analysis. Through the comparison between thetext rules and practices, we can summarize and show problems in theexisting procedures, then propose the preliminary forecast to itsimprovement.The conclusions of this article are: Firstly, the rule establishment ofLocal people’s Congress legislative review procedure has provided thebasic framework to exercise its power, but it’s very crude in general. Secondly, missing critical system factor is proved to be the importantreason for restricting its overall function. And lastly, existing systems ofpeople’s congress legislative review procedure need to be refined,meanwhile, one thing one debate,“side argumentative side decidedand some other critical system factors need to be introduced andpromoted to run in a rational and efficient way.
