The Legal Attribute Of Network Virtual Property And Its Legal Protection

The rapid development of Internet technology has spawned various new things, with the virtual property being one of them. However, the developing process of the new things is always tortuous, and virtual property is no exception. The relevant legal disputes emerge in an endless stream in recent years. However, due to legal lag in our country at present, the legislation of virtual property is still in a blank state. To fill this gap, we must make full theoretical research on the virtual property as soon as possible, and perfect the legal protection system of virtual property according to the research results as well.First, this thesis will approach the concepts, characteristics and legal character of virtual property. Then, the author will introduce the legislative and judicial status in China and other countries. At last, I will put forward some legislative and judicial suggestions to solve the existing problems. This thesis consists of three chapters.Chapter1mainly expounds the origin of the virtual property, the concept, characteristics and legal attribute of it. Through introducing the origin and development of virtual property, this chapter first puts forward the concept of virtual property. Then, the author points out the virtual property’s five characteristics: virtuality, value, legitimacy, and limit, disposable. Finally, the author will make some comments on the theory about the legal attribute of virtual property, and put forward my own suggestion.Chapter2mainly introduces legislative and judicial status both in China and in the other regions and countries. First, an introduction about the current situation of legislation and juridical practice in China are presented and some problems are pointed out. Next, the author gives an introduction about the legislative status in other countries with a hope of using the experience of other countries for reference.Chapter3is about the suggestions to improve the legal protection system of virtual property in China. In the beginning the necessity to improve the relevant system is proposed. Then the author will put forward some legislative and judicial suggestions to the existing problem.
