Adding the Dangerous-Driving Crime to 《Amendment VIII to the Criminal Law of the People’s Republic of China)) is under the good motivation of safeguard the people’s livelihood, whereas the real effects might be the opposite.Firstly, it would cause unjust punishment with other types of dangerous-driving behaviors if only criminalize drunken-drive and car-racing. Secondly, it probably violates the constitution for leading the fabrication and conflict of the related Administrative Law. Thirdly, it cause the dilemma of "selective enforcement", which would exacerbate the extremely insufficient condition of our country’s police strength and judicial resources, and the dangerous-driving would take it’s own course to a higher degree, eventually increase the possibility and peril of the grievous traffic accident. Last but not the least, it causes the conflict between the legislation and national culture habitsIncriminating the behaviors of dangerous-driving can not essentially change the citizens’habit of drinking and driving, contrarily it would engender an inappropriate damage of the people’s livelihood and welfare. Consummating the present administrative law and enforcing it with more power, as well as reasonably explaining the criminal law in effect can be more effective in preventing and controlling dangerous-driving.
