China's Anti-monopoly Law Forgiveness System Research Review

The Leniency Program of Anti-monopoly Law is very effective in combating agreement monopoly. In recent year, It becomes the important action in the competition law countries. In our country, The leniency Program of Anti-monopoly Law is still a new research subject, but with China’s Anti-monopoly Law come on stage, The Scholars begin to pay close attention to the leniency Program, and obtain a certain academic achievements. Especially, in the Anti-monopoly Law after implementation, the leniency Program also become gradually scholars studies focus on the issue.The thesis for the purpose of reviewed the research results of our country leniency Program of Anti-monopoly Law. Through made statistics on the basis of research of our Leniency Program in nearly two decades, the thesis analyzed of current researching in the Leniency Program of Anti-monopoly Law, concluded the appellation and connotation of the Leniency Program, explored the theoretical basis of the Leniency Program. Concluded and made commentary analyze the negative effect problem which the Leniency Program may have. Besides, Put forward the shortcomings that exist in the process of Chinese scholars in the research of the Leniency Program. In other word, there were some important problem but those did not cause scholars attention. For example, the problem of the negative application of the Leniency Program in Anti-monopoly Law, the problem of the anti-monopoly civil damage can impact on the Leniency Program and so on. The thesis introduced these problems, and made a preliminary analysis. On this basis, I made my own thinking. And I hope it can provide a material base for the future research.Based on this, the thesis mainly divided into five parts:the summary of research on the Leniency Program in our country, the legitimacy of the Leniency Program, the availability of the Leniency Program, the negative effect problem of the Leniency Program, the Other Problems on the research of our Leniency Program of Anti-monopoly Law.
