Tort Multivariate Assistance System Research

Socio-economic conditions in China today, although the Tort Liability Act has been constantly in self-improvement, in order to better serve the tort liability relief services, but there are still much to be desired, relying solely on the Tort Liability Act, has become increasingly difficult meet the realistic needs of the tort liability relief. Socialization has become the trend today, sharing in the loss of the social security system and the liability insurance system has gradually penetrated into relief for tort liability, and in some ways to play its unique advantage.In this paper, the analysis of the Tort Liability Act, the social security system, the advantages and disadvantages of the liability insurance system for tort liability relief, explained in the present in order to better serve the tort liability relief, these types of tort liability relief system change direction, trying to be the three fusion, to establish such a tort liability relief system:a universal social security system to meet the basic needs of the community, plus a professional and coverage of liability insurance system, and auxiliary personal responsibility and to stimulate the tort law duty of care.The end of the article, the author discusses the applicable rules of this relief system, saying that "the relief of victims to apply for social security or liability insurance system based on the damage to the fact that, while relief after received the difference between the actual loss suffered by the perpetrators infringement damages "additional mode" is more desirable.
