Study On Protection Of Child Sexual Health Rights Of Criminal Law

It is an important principle to give special protection to the rights of vulnerable groups in most countries legislation of the world. Children are the future builders of society, also an absolutely vulnerable group. China’s law has given this vulnerable group special protection, such as the promulgation of the "People’s Republic of China on Protection of Minors Act". The Penal Code also established the crime of child molestation, organizational crime of child begging and other charges. However, with the advent of sexual Liberation of recent years, the number of sexual assault cases involving children is growing, casting a shadow for the healthy growth of children.The criminal law has played an unmatched role in preventing crimes since its emergence. Penalty deterrent effect makes it an effective means of crime prevention. Due to the irreversibility of the growth of children, the negative impact of sexual abuse may ruin a child’s whole life. Therefore sexual health rights of children need the most stringent protection of the criminal law urgently.So Improve the criminal law for the protection of the rights of the child sexual health is now a top priority. In this article, it will be divided into three sections to explore the protection of the criminal law for child sexual health rights, including the following major elements:The first section is the status quo of Criminal Law on protection of children’s rights of sexual health, this section is divided into three parts. Part I proposes the age of fourteen as a dividing line to distinguish children from general minors. In part II the status quo as well as the history of the Criminal Law on child sexual health rights protection is to be introduced. Combined with judicial practice the problems of the Criminal Law on the protection of sexual health rights of the child shall be discussed in part III.The second section introduces the extraterritorial criminal law on child sexual health rights protection. Researching on criminal law of child sexual health rights protection in many countries and region of both two legal systems, this section put forwards some proposals for china’s criminal law. The third section is on our children’s health right protection legislation suggestion; this section is divided into two parts. The first part is the perfect principle, put forwards comprehensive protection and special protection, effective protection as three big principles. Part Ⅱ is about tentative plan of Criminal Law, it proposes perfect recommendations from settings of General Provisions to specific charges.
