Human rights is exotic for our country, and it was introduced with the invasion of Western powers. After the founding of new China, human rights is sensitive issues in a long period of time. However, as the development of China’s economic, our country come to realize the importance of protection of human rights. In2004, constitutional amendment wrote "the state respects and safeguards human rights" into the Constitution. More and more people get ready to study the human rights.Suspect as a special group, their human rights is the most easily overlooked. Because in people’s mind, the suspect is guilty, so they should not be maintained. However, human rights is necessary as a people. The suspects, as people, they should have human rights. In our country, the law on human rights for criminal suspects still not perfect. In the criminal process, especially in the investigation stage, extended detention, torture are popular, and led to the emergence of a number of miscarriages of justice.This paper focuses on the protection of suspects’ human rights. Firstly, introduced the necessity of protecting human rights of suspect, which is the inevitable trend of the world’s development. Secondly, introduced the present situations of protecting human rights of suspect. The foreign countries mainly introduced the United States and Germany, and introduced the first human rights plan of China. Thirdly, introduced the existence questions and its origin of protecting suspect’s human rights in our country.Finally, the paper focuses on the measures of protecting human rights of suspect. For example, establish the limited right to silence rules, improve the presumption of innocence, improve the system of evidence, establish the illegal evidence exclusion rules and ensure the lawyer’s meeting right. Hope through these elaborates can provide some references to the protection of human rights issues.
