Administrative Solving Mechanism In Civil Disputes

Chinese society is in transition, the single lawsuit disputes resolution mechanism cannot meet requirements of society.Establishment of an effective dispute resolution mechanisms in line with China’s national conditions is now urgent legal proposition. Administrative intermediation is a non-litigation relief way to solve the disputes between the parties and it is one of the eastern legal systems, which not only bases on chinese culture,but also fits the actual chinese status. The administrative mediation system has increasingly been one of the important means for administration to resolve the conflicts and disputes. The establishment and improvement of the administrative intermediation will enrich the ways and contents of the administration, will contribute to resolve the disputes completely, to maintain a stable social order, to reduce the burden of judgements and save the judicial resources, furthermore, to build and perfect our multivariate mechanism of dealing with civil disputes. I believe the systematic research on the administrative intermediation system will perfect and to enrich the contents of administrative intermediation and build the harmonious society.But currently Chinese administrative intermediation is low institutionalized and low standardized,did not play its proper role in practice. The operation of administrative intermediation also exist a series of problems in our country,such as scattered legislation, lack of procedural provisions and so on.Based on these problems are discussed, and through draw lessons from the construction of external administrative intermediation of successful experience, more in-depth research on administrative intermediation. This article is focused on the theme of administrative intermediation system to start, in perfect path, I put forward some new ideas and innovation designs of some system, provide a systematic theory basis for the institutionalized and standardized development of administrative intermediation, so as to carry on the analysis to the present administrative intermediation system, and more substantial to solve multiple civil disputes.
