With the reform of china’s housing monetization, expensive commercial properties have played a leading role in the real estate market, and small property rights—an abnormal housing product—come into existence under the heavy pressure of the real estate market. Arguments and studies on small property rights are deepening. When the housing price reached a new record in2009, problems about the existence and management of small property rights once again aroused researchers’attention. Based on their individual understanding of China’s current situation, researchers raised their own opinions on the existence and management of small property rights and illustrated them with their own theories, and proposed ways to realize them correspondingly.This thesis studies on the origins of small property rights with historical analysis. It clearly illustrates the development of small property rights with the development of China’s economy by putting this matter back to history when China was just set up. From one hand, it holds tightly the root of the origins of this matter—China’s land dual system. From the other hand, it works on the causing factors of the lasting developing social policies, especially those on unreasonably rising commercial property price and lost housing assurance. Combined with multi-subjects, this thesis makes an overall analysis on the effects caused by small property rights from the multi-angles of people’s livelihood, law, and food safety. It thoroughly demonstrates that small property rights can not solve "three dimensional rural issues"(problems about agriculture, rural areas and peasantry) or assure people’s rights and benefits; in contrast, they will threat state land and food safety, challenge law dignity, and disturb law system. Thus the conclusion that small property rights need to be eliminated. With this conclusion, future small property rights must be prohibited and existing ones solved. According to the factors causing these problems, small property rights are bound to be dealt with from the following two aspects. First, reform rural land policy and give rural land more capital rights, which is a long-lasting and arduous task. Second, make and perfect China’s housing assurance policy by improving social policy and learning from foreign advanced concept and methods; increase the proportion of personal earnings in national wealth allocation, so that housing price is likely to go back to normal. Last, existing small property rights must be settled properly from the angle’s people’s livelihood to guarantee social stability. In all, small property rights can only be solved effectively if various methods from multi-angles are applied.
